Constitutionalism

Elaborating the concept of constitutionalism by the early western scholars in terms of putting restraints on the powers of the state to ensure maximum liberty to the individual to pursue his/her goals, this chapter discusses this concept with reference to the writings of primarily three African scholars, who in the context of African societies have tried to establish that the western concept is not entirely suitable to the developing societies like Africa where the state is not only to be subjected to constitutional restraints, but is also required to take affirmative steps in order to remove the existing inequalities in the society to ensure protection of liberties of each and every individual.
