Conflicting Court Injunctions and Democratic Consolidation in Nigeria's Fourth Republic 1999-2025

This study examines the implications of conflicting court injunctions on democratic consolidation in Nigeria's Fourth Republic (1999–2025). It investigates the nature, causes, and consequences of contradictory judicial orders issued by courts of coordinate jurisdiction, particularly in political, electoral, and intra-party disputes. Drawing on the Judicialization of Politics Theory, the study argues that increasing reliance on the judiciary for resolving political conflicts has intensified forum shopping, jurisdictional overlap, and inconsistent judicial decisions. Using documentary and qualitative analysis, the study identifies institutional weaknesses, judicial discretion, poor case management, weak enforcement of judicial hierarchy, and political manipulation as the major drivers of conflicting injunctions. The findings reveal that these injunctions undermine the rule of law, erode public confidence in the judiciary, create legal uncertainty, disrupt governance, and weaken democratic institutions. The study recommends strengthening judicial coordination, enforcing judicial hierarchy, improving case management systems, enhancing judicial accountability, and curbing forum shopping to promote judicial coherence, political stability, and sustainable democratic consolidation in Nigeria.
