This study seeks to shed light on the challenges imposed by the digital environment, particularly in the fields of electronic payment and the protection of personal data, as they represent among the most prominent manifestations of the fragility of the consumer’s legal position in cyberspace. The research is driven by a primary objective, namely assessing the effectiveness of the Algerian legislative framework, embodied in Law No. 18-05 on electronic commerce and Law No. 18-07 on the protection of personal data. The findings reveal that legislative intervention constitutes a positive step towards fostering digital trust; however, its effectiveness remains limited in view of the absence of advanced supervisory mechanisms and the difficulty of establishing legal liability in cases of fraud or data breaches.
The study further demonstrates that electronic payment has become indispensable for the success of e-commerce, yet it remains fraught with technical and legal risks that necessitate the development of the legislative system and the strengthening of international and regional cooperation to combat cross-border cybercrimes, thereby achieving a balance between consumer protection and the promotion of investment in the digital economy.
تهدف هذه الدراسة إلى تسليط الضوء على التحديات التي تفرضها البيئة الرقمية، ولا سيما في مجال الدفع الإلكتروني وحماية المعطيات ذات الطابع الشخصي، باعتبارهما من أبرز مظاهر هشاشة المركز القانوني للمستهلك في الفضاء الرقمي، وانطلق البحث من هدف رئيسي يتمثل في تقييم مدى نجاعة الإطار التشريعي الجزائري، ممثلا في القانون رقم 18-05 المتعلق بالتجارة الإلكترونية والقانون رقم 18-07 الخاص بحماية المعطيات الشخصية، وقد خلصت الدراسة إلى أنّ تدخل المشرع يعد خطوة إيجابية نحو إرساء الثقة الرقمية، غير أنّه لا يزال محدود الفعالية بالنظر إلى غياب آليات رقابية متطورة وصعوبة تحديد المسؤولية القانونية في حالات الاحتيال أو خرق البيانات، كما تبين أنّ الدفع الإلكتروني أصبح ضرورة لإنجاح التجارة الإلكترونية لكنه يظل محفوفا بمخاطر تقنية وقانونية تستدعي تطوير المنظومة التشريعية وتعزيز التعاون الدولي والإقليمي لمواجهة الجرائم المعلوماتية ذات الطابع العابر للحدود، بما يحقق التوازن بين حماية المستهلك وتشجيع الاستثمار في الاقتصاد الرقمي.
