Managing Complexity in Electoral Dispute Resolution: Administrative Lessons from Ghana’s 2012 Presidential Election Petition

This study analyzes the administrative strategies employed by the Supreme Court of Ghana in managing the 2012 Presidential Election Petition, a highly complex and politically sensitive case. Rather than focusing on constitutional interpretation, the study emphasizes judicial administration, including strict caseflow management, procedural direction, time control, and coordination among legal counsel, political actors, and technical experts. A key innovation was the appointment of independent technical referees, notably KPMG, to audit disputed electoral materials through systematic verification of polling-station pink sheets and voters’ registers. The findings show that active judicial control, structured evidence handling, and careful management of ambiguities were critical in maintaining fairness, efficiency, and legitimacy under intense public scrutiny. The study highlights administrative lessons for electoral dispute resolution, stressing procedural clarity, standardized documentation, defined institutional roles, and the value of combining judicial oversight with technical expertise in emerging democracies.
