The Proposed Artificial Intelligence Bill (2026): Analyzing the EU Blueprint and the Realities of AI Regulation in Kenya

The rapid proliferation of Artificial Intelligence (AI) has threatened the already frail regulatory frameworks in middle and lower middle African Countries. As jurisdictions, like Kenya, rush to regulate the development, deployment, and use of algorithmic systems, some structural, ethical and legal issues have been laid bare. This article attempts analyzes the ongoing discourse surrounding the proposed Artificial Intelligence Bill, 2026, contextualizing it against its sister, European Union's regulatory model. This paper functions as a commentary and enlightenment of the practical realities facing the Bill and the regulation of AI in our space. It argues that while the Bill and its models offer Kenya a robust starting point, successful regulation requires highly localized institutional harmonization, specialized judicial training and mitigation of the already existing facets related to data protection and sub-version.
